BASIC PROVISIONS
1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) is Jiří Mrkvička, ID No.: 40823300 (hereinafter referred to as “the Controller”).

3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
4. The Controller has not appointed a Data Protection Officer.

SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA
5. The Controller processes personal data that you have provided in connection with participation in the film festival, registration, accreditation, volunteer activity or other forms of involvement in festival activities.
6. The Controller processes your identification and contact data and information necessary for the performance of the contract.
LEGAL BASIS AND PURPOSE OF PERSONAL DATA PROCESSING
7. The legal basis for the processing of personal data is
- the performance of a contract between you and the Controller pursuant to Article 6(1)(b) GDPR,
- the legitimate interest of the Controller in providing direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to processing for the purposes of direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no goods or services were ordered.
8. The purpose of processing personal data is
- to ensure participation in the film festival, handle registration, accreditation or other forms of involvement, and to exercise rights and obligations arising from these relationships; in such cases, personal data necessary for these purposes (e.g. name, address, contact details) are required, and providing them is necessary to enable participation,
- sending commercial communications and conducting other marketing activities.
9. The Controller carries out automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.
DATA RETENTION PERIOD
10. The Controller retains personal data
- for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these relationships (for 15 years after the termination of the contractual relationship),
- for the period until consent to processing for marketing purposes is withdrawn, for a maximum of 15 years, if personal data are processed on the basis of consent.
11. After the retention period expires, the Controller deletes the personal data.
RECIPIENTS OF PERSONAL DATA (CONTROLLER’S SUBCONTRACTORS)
12. Recipients of personal data are persons
- involved in the delivery of goods / services / execution of payments under a contract,
- involved in the operation of services,
- providing marketing services.
13. The Controller intends to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are providers of advertising, hosting, mailing or cloud services.
YOUR RIGHTS
14. Under the conditions set out in the GDPR, you have the right
- to access your personal data pursuant to Article 15 GDPR,
- to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,
- to erasure of personal data pursuant to Article 17 GDPR,
- to object to processing pursuant to Article 21 GDPR,
- to data portability pursuant to Article 20 GDPR,
- to withdraw consent to processing in writing or electronically at the address or e-mail of the Controller specified in Article III of these terms.
15. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe your right to data protection has been violated.
PERSONAL DATA SECURITY MEASURES
16. The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
17. The Controller has implemented technical measures to secure data repositories and personal data storage in physical form.
18. The Controller declares that personal data are accessible only to authorized persons.
FINAL PROVISIONS
19. By submitting an application or registration through an online form, you confirm that you have read and accepted the personal data protection terms in full.
20. You agree with these terms by ticking the appropriate box during registration or application for the festival. By ticking the box, you confirm that you have read and accepted the personal data protection terms in full.
The Controller is entitled to amend these terms. The new version of the privacy policy will be published on the website or sent to your e-mail address provided to the Controller.
These terms take effect on October 21, 2025.
